Terms of Service

1. Acceptance of these terms

By submitting your email address to the Hakalachi waitlist, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please do not submit your email.

2. What the waitlist is — and isn't

The waitlist is an expression of interest in being notified when the Hakalachi service launches. Joining the waitlist:

Does not create a contract for service.
Does not guarantee you access to the service when it launches.
Does not obligate Hakalachi to launch on any particular schedule, in any particular form, or at all.
Does not require any payment.

3. Eligibility

You must be at least 13 years old to join the waitlist (16 in the EU and UK). If you are below the age of majority where you live, you may join only with the consent of a parent or guardian.

4. Your responsibilities

You agree to:

Use a real, accessible email address that belongs to you.
Not submit multiple signups from the same email or attempt to game the waitlist queue.
Not use the waitlist signup form to harass, spam, or harm others.
Not attempt to disrupt, probe, or reverse-engineer the website's infrastructure.

5. Communications you'll receive

By joining the waitlist, you agree to receive:

A confirmation email shortly after signup.
Occasional updates about the launch of Hakalachi.
A notification when the service becomes available.

You may unsubscribe from waitlist emails at any time using the link in any email or by emailing hello@hakalachi.com. Unsubscribing also removes you from the waitlist.

6. Intellectual property and your work

What we keep.Hakalachi retains all rights in the platform code, the “Hakalachi” name, the “Hakalachi//OS” mark, the theme designs we provide (including the Hakalachi//OS and Comic Book themes), the website design, the mascot, and all other proprietary content we provide. You may not copy, modify, distribute, or use any of these to operate a competing service.

What is yours. The designs, configurations, custom alert text, uploaded sounds, and any other content you create or upload using the service belong to you. You may export them in open formats at any time during your subscription. Statutory rights of data access and deletion (including under GDPR, CCPA, and similar regimes) apply regardless of subscription status.

Platform code and self-hosting. The platform code itself is not currently offered for self-hosting; Hakalachi is designed and operated as a fully hosted service. The licensing model that governs the platform code is a deliberate open decision and may change in the future. Any change will be reflected in an updated version of these Terms before it takes effect.

7. Disclaimers

The waitlist and any pre-launch communications are provided “as is.” To the maximum extent allowed by law, Hakalachi disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the waitlist will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent allowed by law, Hakalachi will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the waitlist, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed one hundred dollars (US $100).

9. Termination

We may remove you from the waitlist at any time, for any reason, with or without notice — including (but not limited to) violations of these Terms.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify waitlist members by email before the changes take effect. Your continued participation after the effective date constitutes acceptance of the updated Terms.

11. Governing law

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
